PRIVACY POLICY

Entity: Escrow Enterprise (Registration No. 202303020746)

Platform: escrowpay.com.my

1. DATA COLLECTION & PURPOSE

We collect Personal Identifiable Information (PII) solely for the purpose of facilitating secure escrow transactions and complying with mandatory eKYC (electronic Know Your Customer) and AML (Anti-Money Laundering) regulations in Malaysia.

2. USER-TO-USER PRIVACY (NON-DISCLOSURE)

To maintain a secure and neutral environment, Escrow Enterprise enforces a strict non-disclosure policy between transacting parties.

  • Identity Protection: Neither the Buyer nor the Seller is permitted to request, and the Company will not provide, the other party’s identity information, contact details, or private documentation.

  • Neutrality: All communication and verification are handled through the Escrow Enterprise platform to ensure privacy is maintained throughout the transaction lifecycle.

3. LEGAL DISCLOSURE & GOVERNMENT REQUESTS

While we prioritize user anonymity, we comply with the rule of law. Escrow Enterprise will disclose any information currently in our possession (or information we are technically able to provide) to third parties only under the following circumstances:

  • Court Orders: Receipt of a valid and enforceable subpoena or court order issued by a Malaysian court.

  • Governmental Mandates: Valid requests from regulatory bodies or law enforcement agencies (e.g., Bank Negara Malaysia, PDRM) that the Company deems legal, fit, and mandatory.

  • Scope of Disclosure: If the data has already undergone Cryptographic Anonymization (as per Section 4), the Company can only provide the de-identified, encrypted records as they exist in our siloed audit logs.

4. THE DE-IDENTIFICATION PROCESS

As soon as a transaction is confirmed as "Complete" by the Buyer:

  • All PII associated with that specific transaction is processed through Cryptographic Anonymization.

  • This renders the data unreadable for standard operational use.

  • This process is designed to protect users from data breaches, as the "readable" data effectively ceases to exist in our active database once the business purpose is fulfilled.

5. DATA RETENTION

In accordance with Malaysian financial laws, we maintain an encrypted, non-readable record of transactions for the statutory period (typically 7 years). This "Offline Vault" is not used for marketing or customer service and is only accessed for the legal disclosures mentioned in Section 3.

6. NO DATA SELLING

Escrow Enterprise does not sell, rent, or trade user data to third-party marketers. Your information is used strictly for the escrow service you have requested.
